Foreign nationals



The conditions for the entry, movement, residence and work of foreigners as well as working conditions and rights of workers assigned to work in the Republic of Croatia are regulated by the Act on Amendments to the Act on Asylum (Official Gazette No. 70/15, 127/17), the new Act on Foreigners (Official Gazette No. 130/11, 74/13, 69/17) and the Act on Amendments to the Act on Croatian Citizenship (Official Gazette No. 130/11, 110/15).
 
In the new Act on Foreigners the provisions relating to the entry, residence and employment of foreigners are in line with the legal acts of the European Union. Special attention was paid to the free movement of workers and the provisions relating to the entry, residence and work of citizens of Member States of the European Economic Area and members of their families as well as to the residence and work of highly qualified third-country nationals (holders of the "EU Blue Card").
In accordance with the fundamental principles of the migration policy of the Republic of Croatia that are based in the constitutional norms and international conventions acceded to by the Republic of Croatia, the norms to protect the rights of foreigners with a regulated stay and work in the Republic of Croatia, if their actions do not threaten public order and the Croatian national security, are embedded in the Act on Foreigners.

In the Republic of Croatia a foreigner can work on the basis of a granted residence and work permit or work registration certificate, unless the Act prescribes otherwise. Residence and work permits can be granted on the basis of the annual quota and outside the annual quota system. Foreign citizens can work in the Republic of Croatia without residence and work permit or work registration certificate, provided they have been granted the following:
  • permanent residence,
  • asylum, subsidiary or temporary protection,
  • temporary residence for the purpose of family reunion with a Croatian citizen, a foreigner with permanent residence, an asylee or a foreigner who has been granted subsidiary or temporary protection,
  • temporary residence on humanitarian grounds,
  • autonomous stay,
  • the status of a regular pupil or student where they perform their work through authorized agents, without commencing employment,
  • temporary residence for the purpose of scientific research.
A citizen of the EEA Member States and members of his family may work and provide services in the Republic of Croatia without a residence permit or work certificate.
The provisions of the Act on Foreigners relating to nationals of the EEA Member States also apply to nationals of the Swiss Confederation.
The provisions of the Act on Foreigners relating to members of the family of nationals of a Member State of the EEA apply to foreigners - members of the family of Croatian nationals.
 
NOTE: On 1st July 2013, the Regulation on the provisional application of the rules of procedure of nationals of Member States of the European Union and members of their families (Official Gazette 79/13) came into force, which sets out temporary application of the rules of work of nationals of Member States of the European Union and members of their families who are nationals of Member States of the European Union which apply national mesures or measures which arise from bilateral agreements on the work of the citizens of Republic of Croatia and members of their familiy.
 
The work of nationals of Member States of the European Union and members of their families regardless the fact whether they are nationals of a Member State of the European Union or a third country, equivalent reciprocal measures shall apply. The measures apply to the work of nationals of the EU Member States and their family members until the Member States of the European Union will apply the same national measures or measures arising from bilateral agreements as regards the work of nationals of the Republic of Croatia and their family members.

The provisions of this Act relating to the residence and work of foreigners shall not apply to members of diplomatic missions, consular offices, members of the missions of the organizations of the United Nations and other specialized institutions of the United Nations, members of the missions of international organizations accredited in the Republic of Croatia and members of their families, that is, households.
